This Privacy Policy explains how Nexase LLC, doing business as FMRX ("FMRX," "we," "us," "our"), collects, uses, and protects your information when you use our AI-powered Vedic astrology services through our website, iOS application, and related services (collectively, the "Services").

1. Information We Collect

1.1 Information You Provide

  • Account Information: Email address, username, password (stored in encrypted form)
  • Birth Information: Date, time, and place of birth, and optionally gender (required for astrological calculations)
  • Contact Information: Phone number (for SMS verification only — see our SMS Terms)
  • Profile Information: Display name, avatar, focus areas, and "about me" text (optional)
  • Journal Entries: Content you write in the journal feature
  • Chat Messages: Messages you send to our AI assistant and the conversation history

1.2 Location Information

  • Birth Location: The city and country of birth you provide, and the geographic coordinates we derive from it
  • Current Location (optional): With your permission, we collect your device's precise location (GPS) to provide location-based astrological timing features. You can disable this at any time in your device settings or in the app, and you may enter a location manually instead
  • Approximate Location: Derived from your IP address

1.3 Information Collected Automatically

  • Device information (device model, operating system, app version, browser type)
  • IP address
  • Usage data: features used, screens viewed, session duration, and interaction patterns, collected through our analytics provider (Amplitude), which may include session replay — a reconstruction of how you interact with app screens. Session replay is configured to mask sensitive input fields
  • Crash and error data collected through our error-tracking provider (Sentry)
  • Cookies and similar technologies on our website (see our Cookie Policy)

1.4 Payment and Subscription Information

  • iOS App: Subscriptions purchased in our iOS app are processed by Apple. We do not receive your payment card details. We receive subscription status information (e.g., product, purchase and renewal dates, transaction identifiers) from Apple via our subscription-management provider, RevenueCat
  • Web: Payments made on our website are processed by Stripe. We do not store your full payment card number. We receive limited billing information (e.g., a customer identifier and subscription status) from Stripe

1.5 Data We Generate

  • Birth charts and astrological calculations derived from your birth information
  • Personalized readings, forecasts, and interpretations, including AI-generated content

2. How We Use Your Information

  • Provide the Services: Generate birth charts, transits, and personalized astrological insights and forecasts
  • AI Features: Process your inputs to generate AI-powered readings, chat responses, and journal reflections (see Section 3)
  • Account Management: Authenticate users, manage accounts and subscriptions, and provide customer support
  • Improve the Services: Analyze usage patterns to fix problems and improve features and user experience
  • Communications: Send verification codes, security alerts, and service updates
  • Legal Compliance: Comply with applicable laws and enforce our terms

2.1 Legal Bases (EEA/UK Users)

Where the EU or UK General Data Protection Regulation applies, we process your personal data on these legal bases:

  • Performance of a contract: account data, birth information, and generated astrological content needed to deliver the Services you request
  • Consent: precise device location, optional profile details, and non-essential cookies. You may withdraw consent at any time
  • Legitimate interests: service analytics, error tracking, security, and fraud prevention, balanced against your rights
  • Legal obligation: tax, accounting, and lawful requests

3. AI Processing

FMRX uses large language models operated by Anthropic (Claude) to generate readings, chat responses, and journal reflections. When you use these features, relevant information — which may include your birth chart data, focus areas, journal entries, and chat messages — is transmitted to Anthropic for processing on our behalf.

  • Anthropic processes this data as our service provider under a data processing agreement and does not use it to train its models
  • We do not sell your inputs or AI-generated outputs
  • AI-generated content is for informational and reflective purposes only and is not professional advice (see our Terms of Service)

4. Data Sharing and Disclosure

4.1 We Do NOT:

  • Sell your personal information, and we have not sold it in the preceding 12 months
  • Share your birth information, journal entries, or chat content with advertisers or data brokers
  • Use your phone number for marketing purposes
  • Share your mobile phone number or SMS opt-in consent with third parties or affiliates for marketing or promotional purposes

4.2 We Share Information With:

  • Service Providers (Subprocessors): Companies that process data on our behalf under contractual safeguards — including Anthropic (AI processing), Apple and RevenueCat (iOS subscriptions), Stripe (web payments), Twilio (SMS verification), Amplitude (analytics), Sentry (error tracking), and Google Cloud (hosting and storage).   • For Legal Reasons: When required by law, legal process, or to protect the rights, property, or safety of FMRX, our users, or others
  • Business Transfers: In connection with a merger, acquisition, or sale of assets, subject to this Policy
  • With Your Consent: When you explicitly authorize us to share information

5. Your Rights and Choices

Depending on where you live, you have the right to:

  • Access / Know: Request a copy of the personal information we hold about you
  • Correct: Correct inaccurate personal information
  • Delete: Request deletion of your account and associated data. You can delete your account directly in the app (Settings → Account → Delete Account) or by contacting us
  • Portability: Receive your data in a structured, machine-readable format
  • Object / Restrict: Object to or restrict certain processing (EEA/UK)
  • Withdraw Consent: Where processing is based on consent, withdraw it at any time (e.g., disable location access)

To exercise any of these rights, contact us at support@fmrx.ai. We will verify your identity and respond within the timeframe required by applicable law. We will not discriminate against you for exercising your rights. EEA/UK users may also lodge a complaint with their supervisory authority.

5.1 California Privacy Rights (CCPA/CPRA)

If you are a California resident:

  • You have the rights to know, correct, delete, and port your personal information, as described above
  • Sensitive Personal Information: Your birth date and precise geolocation are "sensitive personal information" under the CPRA. We use them only to provide the Services you request (astrological calculations and location-based features) and not to infer characteristics for advertising. We do not sell or "share" (for cross-context behavioral advertising) your sensitive personal information
  • We do not sell or share your personal information as those terms are defined in the CPRA, and we do not use it for cross-context behavioral advertising
  • You may exercise rights through an authorized agent, and you have the right not to receive discriminatory treatment for exercising your rights

6. Data Retention

  • We retain your information while your account is active and as needed to provide the Services
  • Upon account deletion, we delete or de-identify your personal information within 30 days, except where retention is required by law (e.g., transaction records for tax purposes)
  • AI processing logs held by Anthropic are automatically deleted per its retention policy
  • SMS verification codes expire within 10 minutes and are not retained after expiry

7. Data Security

  • Encryption in transit (HTTPS/TLS) for all data transmission
  • Passwords stored using secure hashing algorithms
  • Access to personal data limited to personnel with a need to know
  • Periodic review of our security practices

Important: No method of transmission or storage is 100% secure. We cannot guarantee absolute security.

8. International Data Transfers

We are based in the United States and process data there and in other countries through our service providers. Where we transfer personal data from the EEA, UK, or Switzerland, we rely on appropriate safeguards, including the European Commission's Standard Contractual Clauses incorporated in our agreements with subprocessors.

9. Children's Privacy

The Services are intended for users 18 years of age or older. We do not knowingly collect personal information from anyone under 18. If you believe we have collected information from a minor, contact us immediately at support@fmrx.ai and we will delete it.

10. Cookies and Tracking

Our website currently uses only essential cookies — a security (CSRF) cookie and, when you sign in, a session cookie. We do not set analytics or advertising cookies on the website. If we introduce non-essential cookies in the future, we will ask for your consent through a cookie banner before setting them. See our Cookie Policy for details.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting a notice on our website or in the app, emailing registered users, and updating the "Last Updated" date above.
