End User License Agreement

This End User License Agreement ("EULA") is a binding agreement between you and Nexase LLC, doing business as FMRX ("FMRX," "we," "us," "our"), for your use of the FMRX mobile application (the "App"). By downloading or using the App, you agree to this EULA, our Terms of Service, and our Privacy Policy.

1. License Grant

FMRX grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, for your personal, non-commercial use, as permitted by the App Store Terms of Service (including the Usage Rules) and this EULA.

2. License Restrictions

You may not:

  • Copy, modify, distribute, sell, lease, or sublicense the App or any part of it
  • Reverse engineer, decompile, or disassemble the App, except as permitted by applicable law
  • Circumvent authentication, security, or subscription controls
  • Use the App for any unlawful purpose

3. Auto-Renewing Subscriptions

  • Certain App features require a paid auto-renewing subscription. The subscription title, duration, and price are displayed in the App at the point of purchase before you confirm
  • Payment is charged to your Apple Account at confirmation of purchase
  • Your subscription renews automatically for the same duration at the displayed price unless you cancel at least 24 hours before the end of the current period
  • You can manage or cancel your subscription at any time in your device Settings → Apple Account → Subscriptions
  • Refunds for App Store purchases are handled by Apple; you may request one at reportaproblem.apple.com
  • Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription

4. Informational Purposes Only; No Professional Advice

All content in the App — including astrological interpretations, forecasts, and AI-generated readings, chat responses, and journal reflections — is for informational, reflective, and entertainment purposes only. It is not medical, psychological, legal, financial, or other professional advice, and it is not a prediction of future events. AI-generated content may contain inaccuracies. Always consult qualified professionals for important decisions.

5. Privacy

Our collection and use of personal information in connection with the App — including birth information, optional precise location, journal entries, and AI chat processing — is described in our Privacy Policy.

6. Apple-Specific Terms

The following terms apply to the version of the App downloaded from the Apple App Store:

  • Acknowledgement: This EULA is between you and FMRX only, not with Apple Inc. ("Apple"). FMRX, not Apple, is solely responsible for the App and its content
  • Scope of License: Your license is limited to a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the App Store Terms of Service, except that the App may be accessed by other accounts associated with you via Family Sharing or volume purchasing
  • Maintenance and Support: FMRX, not Apple, is solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services for the App
  • Warranty: FMRX is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are FMRX's sole responsibility
  • Product Claims: FMRX, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation
  • Intellectual Property Rights: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, FMRX, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim
  • Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties
  • Developer Contact: Questions, complaints, or claims regarding the App should be directed to Nexase LLC at support@fmrx.ai, https://fmrx.ai/
  • Third-Party Terms: You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement)
  • Third-Party Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary

7. Termination

This EULA is effective until terminated. Your rights under this EULA terminate automatically if you fail to comply with its terms. Upon termination, you must cease all use of the App and delete all copies.

8. Disclaimers and Limitation of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXASE LLC DISCLAIMS ALL IMPLIED WARRANTIES AND LIMITS ITS LIABILITY AS SET OUT IN OUR TERMS OF SERVICE, WHICH APPLY TO YOUR USE OF THE APP. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

9. Governing Law

This EULA is governed by the laws of the United States and the State of New Mexico, without regard to conflict-of-law principles, except where the law of your place of residence provides non-waivable protections.
